Recent Case
Khalida acted for a client who was a claimant in a breach of trust matter under the Trustee Act 1965. The case was about family members who had usurped the rights of their nephew when they had orally agreed to hold three properties on trust for him. The matter first arose in or around March 2008 when the client approached his aunt to hold the family home on trust for him and his family for a short period. Later on that year he purchased a further two properties on his maternal uncles name. The Client first approached Khalida in 2015 and sought advice, after strategically preparing the case and rectifying the errors from the previous solicitors. The case was finally heard and the client’s case was accepted by the courts and a declaration made that the uncle and aunt held the properties on trust for the claimant. He was also awarded his costs. The learned judge stated in his handing down of judgement that trust cases are not difficult, all you have to do is “follow the money”. This was a very emotionally charged case and took a while for it to be concluded, all was worth while after the client reaped his reward after years of struggling to obtain justice.
